Terms and Conditions :

Topgrade.in or Topgrade means Topgrade E-learning study portal, hereinafter called as TG. Any student/user caught employing unfair practice during or while or after the Admission/Test/Enrolment/using TG E-learning study portal, TG is subject to immediate expulsion from the TG Registry and no refund of fee already paid shall be made at any cost.

We TG reserves the right to accept or reject your application at any stage.

While taking admission to TG you (the user) are deemed to have accepted the terms and conditions listed below : The agreement between you and the TG shall be subject to the following terms and conditions:-

1. The User certifies that he/she has the consent of a parent or legal guardian for using TG.
2. These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail not withstanding any variance with any other terms of any order submitted. By using the TG Online Services (TGOS) you agree to be bound by the Terms and Conditions.
3. All prices, unless indicated specially are in Indian Rupees.
4. All prices and availability of products/services are subject to change without prior notice at the sole discretion of TG Online Service. TG reserves the right to refuse or cancel any order placed for a product/service, which is listed at an incorrect price.
5. In a credit card transaction, you must use your own credit card. TG will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to prove otherwise shall be exclusively on the user.
6. Any request for cancellations of orders once duly placed on the site, shall not be entertained. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or email address) any extra cost incurred by TG for redelivery/regeneration shall be claimed from the User placing the order.
7. TG shall not be liable for any delay / non-delivery of purchased goods (Study materials, Online Tests, any assignments) by the vendors, trade organisation/s, manufacturers / shop etc. (vendors), flood, fire, wars, acts of God or any cause that is beyond the control of TG.
8. All products/services are duly screened and assured by the vendors to ensure that the products/services are of the standard, quality, composition, style or model that they represent.
9. The User agrees to use the services provided by TG through their website https://topgrade.in for lawful purposes only.
10. The User agrees to provide authentic and true information.
11. TG reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly), TG has the right in its sole discretion to reject the registration and debar the User from using https://topgrade.in and / or other affiliated websites without prior intimation whatsoever.
12. TG will not be responsible for any damage suffered by users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor.
13. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.
14. The User agrees clearly that the use of service(s) TG Online Service is at the Users sole risk. The Service(s) of TG Online Service is provided without warranties of any kind whether expressed or implied. TG affiliates, employees, agents, consultants, contracted companies make no warranties of any kind, whether expressed or implied for the service it is providing or as to the results that may be obtained from the use of the Service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this Service.
15. TG does not represent or warrant maintaining the confidentiality of information although TG current practice is to utilise reasonable efforts to maintain such confidentiality. It is also clearly understood that all warranties, implied or expressed take place between the vendors and the User.
16. It is for the student to see whether he/she is eligible for a TG E-learning study center or not. TG is not responsible if a student’s admission form cannot be forwarded or is rejected by the examination body on any ground whatsoever. Such a student cannot claim a refund of the whole or any part of the fee he/she has paid to the TG.
17. The responsibility of getting admission form forwarded to the examining body is that of the student himself/herself or that of the Parents / Guardian.
18. TG reserves the right to use the photograph for publicity in case the student secures position/success in his education related career.
19. Any change in the correspondence email address or phone number should be intimated to Registered Office immediately through a email quoting the Name, Reference ID, the student and through online update profile request link.
20. Every student will be issued a valid contactID. The entry into the TG online portal will be permitted to only registered student with valid contactID. If any student is found misusing the login credentials, he/she will be rusticated from the TG. In case any parent/guardian/student misbehaves with any staff members of the TG unlawfully, his/her admission can be rusticated and banned from using the TG study portal and no claim to retain such student will be entertained.
21. Any unlawful distribution of user's login credentials such as user Id and Password, any online content, study materials, Question set, Assignments, or any other relevant information is strictly prohibited. In case any user/parent/guardian/student/anyone entity misbehaves and found guilty, he/she will be rusticated and banned from using TG E-learning study portal and no claim to retain such user/student will be entertained alongwith appropriate legal action will be initiated.
22. User should not share his/her login credentials to other it is strictly prohibited, if he/she does so, he/she will not able to use TG online services and found doing so, will be liable to discontinue TG online services.
23. Subscription fees are valid only for academic year. After completion of academic year student/user has to pay specified subscription fee towards TG to user the services without interruption.
24. Subscription fee and Course fees are two different entities. After payment of subscription fee user/student should pay relevant course fee which he/she choose to use corresponding courses and guidance of particular trainer. Student/user can pertain many of course as he/she can. Subscription fee is towards administrative expenses incurred by the TG.
25. If at any point of time, the Govt. further increases/ changes any relevant taxes, the extra amount will be borne by the students from the date of enforcement of the act by the Govt. TG reserves the right to make any alteration in its programs / services / timing / dates, etc. without any prior notice to anybody.
26. The decision of the TG founder/Director will be final & binding on the students and the parents. In case of any dispute, arising out of present terms & conditions, same shall be referred to the sole arbitrator to be appointed by the founder of TG. The seat of founder will be at Sangli only. Unfortunately, if any matter will be in the court, only Sangli Court shall have jurisdiction to decide such matters.
27. While using the TG Online Service (TGOS), you (the user) are deemed to have accepted the following terms and conditions - TG reserves the right to add, delete, alter or modify these terms and conditions at any point of time. The User is therefore advised to read carefully these terms and conditions every time he/she uses the TG Online Service(s).
28. All products / services and information displayed on TG Online Service constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions given below. TG Online Services reserves the right to accept or reject your offer.
29. REFUND POLICY FOR TG online study COURSES :
1. User/Students are requested to read carefully all terms and conditions before registration to avoid any inconvenience. We are not responsible for any misunderstood registration made by the user as there is no cancellation of registration or refund of Admission / Enrollment / Registration fee or transfer of registration in any other name/entity.
2. User/Students are requested to know more about particular course module in details and should understand whether the course module is beneficial/necessary for him/her which he/she want to subscribe before subscribing any course module, so as to avoid any inconvenience to him/her. We TG are not responsible for any misunderstood subscription of course module made by the user as there is no cancellation of subscription or change/amendment in subscription made by user under any circumstances. Also he/she will not allowed to choose any other course module in the way of replacement manner.
3. No refund of Admission / Enrollment / Registration fee shall be made under any circumstances whatsoever.
4. No refund of Subscription / Course / Course Module Fee shall be made under any circumstances whatsoever.
5. No refund will be made by means of any way of mode; under any circumstances after joining the TG and gets Enrollment Number in his/her name or subscription is made for any course module.
6. Admission/Registration is not transferable.
30. TG management holds all the rights to sanction or reject Application of student for admission to TG online services at any stage.
31. CONFIDENTIALITY INFORMATION AND DISCLAIMER:
       Email message and its attachments sent by TG may contain confidential, proprietary or legally privileged information and is intended solely for the use of the individual or entity to whom it is addressed for better way of fulfilling service. If anyone have erroneously received message, please delete it immediately. If anyone are not the intended recipient of the email message he/she should not disseminate, distribute or copy the e-mail. E-mail transmission cannot be guaranteed to be secure or error-free as information could be intercepted, corrupted, lost, destroyed, incomplete or contain viruses and we accepts no liability for any damage caused by the limitations of the e-mail transmission although all security measures are followed as per standard at our end.
